Welcome to India Advocacy! Please read these terms and conditions carefully before using our services. By accessing or using our services, you agree to be bound by these terms and conditions, which constitute a legally binding agreement between you and India Advocacy.

Description of services

India Advocacy provides users with access to a variety of services, including legal advocacy services and related content, as well as other general information and services (the "services").

Use of services

By accessing or using the services, you represent and warrant that you are at least 18 years old or have legal parental or guardian consent to enter into these Terms, and that you will use the services in compliance with all applicable laws and regulations.

You agree to use the services only for lawful purposes and in accordance with these Terms. You shall not use the services in any way that violates any applicable national, state, local, or international law or regulation, including any laws regarding the export of data or software to and from India or other countries.

You shall not transmit or procure the sending of any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.

You shall not impersonate or attempt to impersonate India Advocacy, a India Advocacy employee, another user, or any other person or entity.

You shall not engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the services or which, as determined by India Advocacy, may harm India Advocacy or users of the services or expose them to liability.

Intellectual Property

India Advocacy is the owner of all the rights to the services and everything included in them. You can use the services for your own personal and commercial use only, but you are not allowed to do things like copying, sharing, changing, displaying, or publishing any of the material on the services, unless these Terms specifically allow it. You cannot use our services to generate business.

User Content

You may be allowed to submit User Content through the services, but you must own or have the necessary licenses, rights, consents, and permissions to use and authorize India Advocacy to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all User Content. The User Content, and India Advocacy's use of the User Content as contemplated by these Terms, must not infringe, violate, or misappropriate any third-party right, including any intellectual property or proprietary right, slander, defame, or libel any person, or result in the violation of any applicable law or regulation.

By making any User Content available through the services, you grant India Advocacy a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised, without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.

India Advocacy has the right, but not the obligation, to monitor, review, edit, modify, or delete any User Content, and to take action against any user who violates these Terms.

Modifications to services and Terms

India Advocacy reserves the right to modify or terminate the services with reasons or to modify the Terms at any time, without prior notice to users. It is the responsibility of users to regularly review the Terms to stay informed of any changes. Continued use of the services after any such changes shall constitute users' consent to such changes.

Indemnification

Users agree to defend, indemnify and hold harmless intent towards India Advocacy, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys' fees) arising out of or relating to their use of the services, including but not limited to their User Content, their violation of the Terms, their violation of any rights of another person or entity, or their violation of any applicable law or regulation.

Governing Law and Jurisdiction

The Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the state of Tamil Nadu, India, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of or related to the Terms or the services shall be instituted exclusively in the courts of Chennai, Tamil Nadu, India.

Termination

India Advocacy reserves the right to terminate or suspend access to the services immediately, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of the Terms. Termination or suspension may result in the forfeiture and destruction of all information associated with a user's account. All provisions of the Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Refund Policy

Any fees paid to India Advocacy for the use of the services are non-refundable. However, if a user believes that they have been charged in error, they may contact India Advocacy's customer support to request a refund.

Privacy Policy

India Advocacy's Privacy Policy outlines how personal information is collected, used, and disclosed by the company. By using the services, users consent to the collection and use of their personal information in accordance with India Advocacy's Privacy Policy.

Entire Agreement

The Terms constitute the entire agreement between users and India Advocacy regarding the use of the services and supersede all prior and contemporaneous agreements and understandings, whether written or oral.

Waiver and Severability

No waiver by India Advocacy of any term or condition set forth in the Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of India Advocacy to assert a right or provision under the Terms shall not constitute a waiver of such right or provision. If any provision of the Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

Assignment

Users may not assign or transfer their rights or obligations under the Terms without the prior written consent of India Advocacy. India Advocacy may assign or transfer its rights or obligations under the Terms without restriction.

Notices

Any notices or other communications provided by India Advocacy under the Terms, including those regarding modifications to the Terms, will be given by India Advocacy by posting on the services or by email. For notices made by email, the date of receipt will be deemed the date on which such notice is transmitted.

Waiver of Class Action Rights

By using the services, you hereby expressly waive any right to participate in a class action lawsuit or class-wide arbitration.

Immunity to Litigation

By using the services, you acknowledge and agree that India Advocacy, its officers, directors, employees, and agents shall not be liable for any damages whatsoever arising out of or in connection with your use of the services. You hereby agree to indemnify and hold India Advocacy, its officers, directors, employees, and agents harmless from any and all claims, losses, damages, and expenses (including attorneys’ fees) arising out of or in connection with your use of the services or your breach of these Terms.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.

No Agency Relationship

No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by these Terms.

Headings

The headings in the Terms are for convenience only and shall not affect the interpretation of the Terms.
